TERMS & CONDITIONS OF BUSINESS
- To provide a service of machine repair/installation etc, to
each and every customer in an efficient, professional and respectful manner.
Hamp Engineering Services & Tools Ltd will be referred to as Hamp through
out these terms.
- The service will continue to be provided on the basis that
payment for works completed is received promptly and in full at the earliest
possible occasion and no later than 30 calender days following the date on
the invoice. Failure to observe the 30 calender day period will result in no
further works being completed until such time as monies are received by Hamp.
Any parts or work in progress being completed on behalf of the customer will
be retained by Hamp until the account is cleared.
- Should payments due to Hamp
of any kind not be received during a Preventative Maintenance Agreement,
then no further regular maintenance visits will be
undertaken until payment of out standing debt is received. If the out standing
debt is not paid and an agreed service agreement date is passed, this Preventative
Maintenance visit is subsequently forfeited and no monies are refundable.
- Full
payment for Preventative Maintenance Agreements is due on signing of the
agreement. Subsequent cancellation of the agreement by the customer
will not attract a rebate of the remaining unused monies and the service
shall be deemed to have been completed on the agreed date. Cancellation
of the agreement by Hamp will follow a notice period of 20 days. Any
monies out standing for agreed services not completed will be returned to the
customer
after any out standing balances due to Hamp are accounted for.
- Any modifications
designed by Hamp will remain intellectual property of Hamp. The customer
will benefit from the use of the improved machinery
but shall have no claim on the design of the machine modification.
Failure to comply with these conditions will result in the removal of
said modification
regardless of whether the machine will be operable.
- If Hamp or
their representative are unable to rectify a machine problem after extensive
investigation then the hourly fee is still payable.
Further attempts to source advice and parts will be undertaken in the
name of the
customer, in order that specialist machine parts can be purchased
directly from a machine manufacturer as soon as possible.
- Payment terms
for call outs will consist of an Hourly charge for service, hourly charge
for travelling, plus any expenses incurred
i.e. flights, accommodation and parts or consumables used or ordered. Payment
terms for Preventative
Maintenance Plans are as agreed with customer following
a survey of plant.

Rates are negotiable for long-term arrangements and projects. Callouts
are charged at a minimum of 2 hours
- Machine failure due to factors unrelated to any work completed by Hamp
and any concluding works required following the customers signing of the service
sheet will incur further costs. Hamp will not be held liable for any subsequent
alteration, damage, or incorrect use of any machinery by a customers employee
following a repair/service completed by Hamp or their representative.
- A prompt payment discount of 10% can be applied if payment
is received on the same day of business, this discount will reduce to 5% if
payment is received up to 14 days of business. Discounts are awarded solely
at the discretion of Hamp and may be withdrawn.
- Any parts fitted to a customer’s machinery will remain
the property of Hamp until such time that payment has been received in full
and has cleared in the bank account. We reserve the right to have entry into
the customer’s premises in order to recover any property that belongs
to Hamp at any time if payment is not forthcoming.
- Hamp will not be held liable
for any consequential loss of production arising out of any act or omission
of Hamp or any of its representatives.
- The equipment included in a Preventative
Maintenance Agreement shall be shown in a schedule of equipment specific
to a customer. If additions
or alterations to the schedule are required then further negotiations
for additional payment will be undertaken with the customer and a new
schedule will be issued, endorsed by both parties and dated.
- Partial Invalidity.
The illegality or enforceability of any provision of these terms and conditions
shall not affect the legality or enforceability
of the remaining provisions.
- The benefit of any agreement made
with Hamp cannot be transferred or otherwise assigned by the customer without
written agreement
of Hamp.
- Hamp reserves the right to sub contract in whole or in part the
services provided under this agreement.
- Customer Obligations with respect to Preventative Maintenance Agreements.
- Use the equipment only in accordance with the normal use and operating
conditions according to the manufacturer and
health and safety authorities.
- Only allow equipment to be operated under
the supervision of trained and competent persons.
- Ensure Hamp and their
representatives have full and free access to the equipment and to any
records of its applications, use, environment and location
kept
by the customer to enable Hamp and their
representatives to perform their service duties.
- Provide adequate and
safe space and surfaces to allow satisfactory access to the equipment
by Hamp and their representatives.
- Provide
clean and dry supply of compressed air. Hamp will not be held liable
for parts failure due to this point not being
complied
with.
- Governing Law. The agreement shall be governed by and construed in accordance
with the Laws of England, and is subject to the English courts.
- Force Majeure.
Neither party will be held liable for delay or failure in performing its
obligations to any agreements if the delay or failure results
from any of the following: Act of God, Government Act, Fire, Flood, Accident,
Industrial Dispute, Riot, impossibility to obtain parts or materials, or
anything beyond the parties reasonable control.
- If the customer has any
cause for complaint against Hamp arising out of any agreement it shall, prior
to any other action, give Hamp a reasonable
opportunity to remedy the damage or event complained of.
- Signing of
the service sheet is deemed to have concluded that particular transaction
to the satisfaction of the customer
and that the customer accepts in full all of the terms and conditions described
above.
TERMS & CONDITIONS OF BUSINESS REGARDING THE SILVERLINE TOOLS RANGE
- All hand tools from the Silverline range sold by Hamptools
have a lifetime guarantee, however
severe damage through misuse of the tool and fair wear & tear is not covered
an assessment
of the tools condition and correct use is entirely left to the judgement of Hamptools,
the customer
on purchasing a tool from Hamptools agrees to this condition also all disposable
blades and routers
are not covered under warranty as these are a consumable wear and tear products.
- Power tools and other electrical items all feature a three year guarantee.
- If any tool from the Silverline range fails within 30 days of the purchase
from Hamptools the
customer should return the tool to Hamptools where we will be happy to replace
the tool with an identical tool or arrange delivery of an identical
replacement free of charge or refund the
cost of the tool. You will need to contact Hamptools on the contact number
given where we will
arrange for the tool to be picked up, also refer to condition (1) at
the top of the page.

fails more than 30 days

- Hamptools can only deliver items the next day to the customer if
we have the items in stock, if we do not have
an item in stock we will obtain and forward the item to the customer as soon
as possible. The customer on payment of an order accepts this as a satisfactory
delivery arrangement.
- All orders are subject to postage and packing charges
the customer on payment of an order agrees to this
condition.
- Payment of an order is defined as completed order online submitted
to us with your credit card details

- On payment of an order the customer agrees to all terms and conditions
set out by Hamptools.
- Force Majeure. Neither party will be held liable for delay
or failure in performing its obligations to any agreements
if the delay or failure

Act, Fire, Flood, Accident, Industrial Dispute, Riot, impossibility
to obtain parts
or materials, or anything beyond the parties reasonable control.
- Partial

- Where
the law requires a minimum age limit for the purchase
of specific goods, you confirm that you are over
the required age limit and that the delivery of any item
sent from Hamptools will be accepted by a person over
the required age limit.
